DE C.V. (referred to as “we”, “us”, “our”). By accessing, browsing, creating an account, placing an order, or interacting with any feature of our website, you confirm that you have read, fully understood, and agreed to be bound by every clause outlined in these Terms.   • You are at least 18 years of age, or hold full legal capacity to enter into a binding contract under applicable Mexican law. If you are under 18 years old, you may only use our platform under the direct supervision and explicit consent of a parent or legal guardian who assumes full responsibility for all your account activities and any associated costs.
  • You are not listed on any international trade sanction, restricted party, or denied person list administered by Mexican government authorities, the United Nations, or any other relevant regulatory body that prohibits you from making commercial purchases on our platform.
  • All information you submit to us during account registration, order placement, or communication with our support team is true, accurate, complete, and kept up to date at all times. We reserve the right to suspend or terminate your account immediately if we find that you have submitted any false, misleading, or fraudulent personal information.

Any bulk reseller, distributor, or third-party entity that intends to resell our products for commercial purposes must contact our dedicated business cooperation team in advance to sign a separate formal wholesale agreement, and is strictly prohibited from making bulk purchases through our regular consumer checkout channel without prior written authorization from us.

2. Account Registration & Security Obligations

When you create a personal My Account profile on our website, you agree to comply with all rules related to account management and security:

  • You are solely responsible for selecting a unique, secure password for your account, and you accept full, unconditional liability for all activities, actions, and transactions that occur under your account credentials, whether or not you have personally authorized that activity.
  • You must immediately notify us via our official contact email [email protected] if you detect any unauthorized access to your account, account security breach, or any other suspicious activity that may compromise the safety of your account data or transaction history. We will never send you unsolicited messages requesting you to share your account password, full payment card details, or two-factor authentication codes, and you agree to notify our support team promptly if you receive any such fraudulent requests claiming to represent FORTICUS TECH.
  • We reserve the full right to disable, suspend, or permanently terminate your account at our sole discretion, without prior notice, if we reasonably determine that you have violated any clause in these Terms, engaged in fraudulent transaction behavior, infringed on our legal rights, or acted in a way that may cause harm to our platform operations or other users’ legitimate interests. After account termination, all pending unshipped orders in your account may be automatically cancelled, and any unused store credit balance associated with your account that has not been obtained through fraudulent activity will be retained for you for a minimum of 180 days, and can be claimed by contacting our support team to arrange redemption.

3. Product Information, Pricing & Transaction Rules

We make every effort to ensure that all content displayed on our www.forticustechmex.com platform is accurate and reliable, but you acknowledge and agree to the following clear rules related to product listings and purchase transactions:

  • All product specifications, images, function descriptions, and performance parameters displayed on our product detail pages are for reference purposes only. Minor, non-material variances in product color, texture, or slight design adjustments that do not affect the core functional performance of the item will not be considered as a false or misleading product description. All our phone cases are designed to withstand daily minor drops and bumps, and all our Type-C accessories are certified to support steady fast charging for compatible devices, with full compliance with Mexican consumer product safety standards.
  • All product prices displayed on our platform are denominated in Euros, and do not include applicable local Mexican value-added tax or customs duties (if applicable to any special cross-border scenarios), unless explicitly stated otherwise at checkout. We reserve the right to adjust product prices, modify or discontinue any product listing at any time, without prior public notice. The price that applies to your order will always be the exact price displayed on the checkout page at the moment you successfully complete your payment process.
  • In the extremely rare scenario that a product listed on our platform is priced at an obviously incorrect, abnormally low value due to unforeseen system error or manual input mistake, we retain the right to cancel your already submitted order even after payment is confirmed, and issue a full 100% refund back to your original payment method without any additional compensation obligation to you. Before we process such a cancellation, our support team will contact you promptly to explain the pricing error and provide you with alternative options to purchase the product at its correct regular price if you still wish to place the order.
  • Once you successfully submit an order and complete payment, a binding purchase contract is established between you and us. You may not unilaterally modify or cancel the order at will after our warehouse has initiated the order processing procedure, unless you have received explicit written approval from our customer support team, and you agree to bear any reasonable logistics fees or operational costs that have already been incurred by our team prior to your cancellation request.

4. Intellectual Property Rights

  • This includes but is not limited to all our original website page design layouts, brand logos, product images, product description text, website source code, graphic designs, marketing copy, video content, all text and visual materials featured on our About Us page, and all proprietary platform features.
  • You are granted a limited, non-exclusive, non-transferable personal license to access, browse, and make personal non-commercial use of our platform content. You are strictly prohibited from reproducing, copying, modifying, distributing, publicly displaying, republishing, scraping, storing in a retrieval system, or using any of our platform content for any commercial, resale, or public dissemination purpose, without first obtaining our explicit written authorization.

We do not exercise any control over the content, privacy protection policies, service rules, or operational practices of these third-party websites:

  • We explicitly disclaim all liability and responsibility for any content errors, data security issues, or property losses that you may encounter when you access and use these third-party external sites.
